A 29-year-old Florida teacher has been arrested and charged with child abuse after surveillance footage allegedly showed her forcefully slamming an 8-year-old student with autism to the classroom floor during what the school described as a de-escalation procedure.
Nikol Marie Rodriguez faces one count of child abuse without great bodily harm following the March 3 incident at Peace Christian Academy in Hialeah. The teacher had been supervising the student since the beginning of the 2024 school year.
According to police documents, the child, who can understand simple instructions but has difficulty expressing his needs, was in a classroom with Rodriguez and two other students when the incident occurred. Surveillance footage obtained through a subpoena showed the teacher initially spinning the boy in what authorities described as an aggressive manner after he was not facing the correct direction while sitting on the floor.
Minutes later, the student moved to a bean bag and sat down. Police noted that while the security camera footage did not capture audio, the child displayed no physically threatening behavior and was simply sitting in place when Rodriguez approached him from behind.
The video allegedly shows Rodriguez pulling the boy’s hands behind his back, prompting him to attempt to escape her grasp while appearing to be in distress. During the ensuing struggle, Rodriguez allegedly slammed the child’s upper body and head onto the classroom floor before forcefully pressing him into a supine position as he kicked his legs. Authorities stated she then pinned the student’s arm to the ground using her leg.
After eventually releasing the child, Rodriguez allegedly shoved him into a table when he attempted to stand up. The entire incident was captured on the school’s surveillance system.
The child’s mother discovered injuries while bathing him later that day. She found a small puncture wound on his right bicep, finger-shaped bruise marks on his left arm, and scratches across his chest. These observations prompted her to contact authorities.
An internal report from Peace Christian Academy, which police obtained during their investigation, characterized Rodriguez’s actions as supportive de-escalation procedures implemented in response to the boy’s escalating behavior. This assessment contrasts sharply with the police interpretation of the surveillance footage.
During Rodriguez’s bond hearing, her attorney maintained a similar position to the school’s internal report, describing the incident as an attempt to restrain a child who was acting out. The defense characterized the teacher’s actions as standard restraint procedures rather than abuse.
Rodriguez was arrested on Thursday and subsequently released after posting a $5,000 bond. Her next court appearance has not yet been scheduled.
The case highlights ongoing concerns about the treatment of special needs students in educational settings and the appropriate methods for managing behavioral situations involving children with developmental disabilities. The stark difference between the school’s characterization of the incident and the police interpretation of the surveillance footage underscores the complexity of determining appropriate intervention techniques in special education environments.
The charge of child abuse without great bodily harm carries potential legal consequences that could impact Rodriguez’s teaching career and personal freedom if she is convicted. The case will likely proceed through the criminal justice system as prosecutors review the evidence, including the surveillance footage that captured the alleged incident.
