A high-profile murder case has taken a dramatic turn after a judge dismissed all charges, citing serious errors by law enforcement.
Aaron Spencer, who had been charged with murder, will no longer face trial after a ruling from Judge Ralph Wilson Jr. determined that critical evidence was mishandled to the point of violating his constitutional rights.
The decision came just weeks before Spencer was set to go to trial.
According to court findings, the case centered around a missing dash camera memory card from the victim’s truck — evidence that may have contained key details about what happened.
Investigators admitted that a detective initially took possession of the dash cam but failed to properly log it into evidence. Instead of being secured in an evidence room, the device remained in the detective’s office.
Over time, the battery drained, settings reset, and when the device was eventually sent for forensic analysis, the memory card was no longer present.
Judge Wilson described the handling of the evidence as “egregious” and ruled that it deprived Spencer of his due process rights, leading to the dismissal of the charges.
The case stems from an incident in October 2024.
Spencer has consistently maintained that he acted to protect his teenage daughter. According to reports, he woke up to find her missing and later located her in a truck driven by 67-year-old Michael Fosler.
Fosler was reportedly out on bond at the time and facing multiple charges involving Spencer’s daughter.
Authorities say Spencer forced the truck off the road, an altercation followed, and Fosler was shot. Spencer then called 911 and remained at the scene.
Despite the seriousness of the incident, the case will not proceed to trial due to the loss of critical evidence.
Spencer, who recently won a GOP primary race for sheriff, has continued to maintain his actions were in defense of his child.
