A devastating accident at a Washington state park has led to a lawsuit after a young child lost his life when a large monument unexpectedly collapsed.
On April 1, 2026, 3-year-old Kaleb Ortega was at Rooks Park in Walla Walla with his father and 5-year-old sister.
Kaleb was near an interactive rock display along the Kingfisher Trail, which includes a memorial dedicated to Capt. Albert H. Rooks and the USS Houston from World War II.
According to reports, the heavy stone monument suddenly toppled, crushing the child in a matter of seconds.
Kaleb suffered fatal injuries at the scene, in front of his father and sister. First responders rushed him to a local hospital, but he later died from his injuries.
In a tragic detail, Kaleb’s mother, Claudia Garcia, works as a nurse at that same hospital and was on duty when her son was brought in by ambulance.
The family says the experience caused her severe emotional trauma.
On May 12, 2026, Kaleb’s parents filed a lawsuit in Walla Walla County Superior Court, also including his sister (through his mother as guardian).
The lawsuit names several companies allegedly involved in the design, construction, or installation of the monument, including:
Boulder Designs
Boulder Designs Franchising LLC
Border Magic (Boulder Magic)
Builders FirstSource
American Rock Products
Wenzel Nursery
Neil Binder and the Binder marital community
Double T Construction
The suit claims the monument was excessively heavy, unstable, and lacked proper support, testing, and warning signs about the risk of it falling.
It cites Washington product liability laws and seeks damages for Kaleb’s death, as well as emotional distress suffered by family members.
As of mid-June, the companies had been notified but had not yet filed responses in court.
